Federal Lawsuit Alleges Cook County Courts Treat Self-Represented Litigants Unequally

CHICAGO, IL — A self-represented Chicago resident has filed a federal civil rights lawsuit, Mayle v. Spyropoulos, against officials of the Circuit Court of Cook County and the City of Chicago, alleging that self-represented litigants are denied access and tools that licensed attorneys routinely receive.

Plaintiff Kenneth William Mayle alleges that attorneys of record can remotely access filed documents in a case from anywhere, at any hour, while self-represented litigants cannot view the same filings without traveling to a courthouse. The complaint also alleges there is no established rule or timeline governing when self-represented litigants are notified that a court has issued an order in their case. Other topics, including requirements for clerk stamps on subpoenas and redaction practices that Mayle alleges are problematic, are also included in the case.

Mayle cites significant due process issues, including alleged concealment of the defendant's noncompliance with court orders, alleged fraud, and discovery violations in Cook County, IL Case No. 2022-L-010246, as events that led him to file this federal case.

Next Steps

Mayle intends to amend the federal complaint to add further factual detail supporting these claims. Mayle is exhausted and for better or worse is seeking legal representation to assist with several ongoing matters, and is separately looking for a member of the press to join the case as a co-plaintiff to raise questions concerning press access to court records.

The case remains pending in the U.S. District Court for the Northern District of Illinois, with no hearing date yet set on the pending amended complaint.
